Definition: "which agency regulates my product" means two different questions
Most importers ask it as one question, but it is really two:
- Who approves my product before it can be sold? (pre-market registration, certification, licensing)
- Who checks it at the border, and who polices it once it is on shelves? (border control vs. market supervision)
Answering both is the difference between a smooth clearance and a container sitting at the port. The Chinese system splits these across seven authorities — and knowing which one owns your category saves weeks of misdirected effort.
The single most common mistake: assuming "customs" is the only gate. For regulated products, the registration authority (NMPA, SAMR, CNCA) decides admissibility long before GACC ever sees the shipment.
The seven agencies that matter for importers

Two more show up on specific products: CNIPA (National Intellectual Property Administration) for trademarks and patents, and provincial/municipal Market Regulation Bureaus that run the day-to-day retail inspection.
Border vs. market: who touches your goods when
- At the port, GACC inspects and quarantines, verifies your declaration and HS code, confirms overseas-manufacturer registration (for food), and collects duty/VAT. If a product needs CCC or an import licence, GACC also confirms those certificates at clearance.
- In the market, SAMR runs sampling, recalls non-compliant products, and polices advertising and pricing. NMPA continues to supervise registered drugs, devices and cosmetics after launch.
- Pre-market, the approval authority (NMPA for devices/cosmetics, SAMR for health food, CNCA for CCC) issues the certificate that makes the product admissible at all.
A product can pass customs and still be pulled from shelves weeks later by SAMR. Plan for both gates, not just the first.
Find your agency in three steps
Step 1 — Name the product category. Food, cosmetics, medical device, drug, electronics/appliance, toy, health-food supplement, or machinery? Category decides everything downstream.
Step 2 — Check for pre-market registration or certification.
- Drugs, medical devices (Class II/III), special-use cosmetics → NMPA registration/filing.
- Health food (blue-hat), infant formula, foods for special medical purpose → SAMR registration.
- CCC-catalogue products (electronics, toys, many appliances, some auto parts) → CNCA certification.
- Food (most categories, plus 17 high-risk under Decree 280) → overseas manufacturer GACC registration.
Step 3 — Confirm border paperwork.
- MOFCOM licence/quota if the item is controlled.
- MOA certificate for agricultural, animal or feed products.
- GACC declaration + overseas-registration proof at the port.
If you cannot name a registration or certification step in Step 2, the product is likely general goods — GACC alone usually clears it, provided labels and HS code are correct.

The pattern is consistent: NMPA owns the product register, CNCA owns the certificate, SAMR owns the market, GACC owns the border. Map your product to those four verbs and you have your answer.
Common traps
- "My EU/US approval covers China." It does not. China applies its own GB standards and NMPA/CNCA regimes. A cosmetic legal in the EU may still need NMPA filing and a China responsible person.
- "Customs will tell me if something's wrong." GACC checks at the port, but admissibility is decided by the registration authority beforehand. An unregistered medical device is stopped regardless of paperwork.
- "CCC is only for big factories." If the HS code falls in the CCC catalogue, the individual importer is liable at clearance — no certificate, no release.

FAQ
Which Chinese agency approves imported cosmetics? The National Medical Products Administration (NMPA). General cosmetics use a simplified filing; special-use cosmetics need NMPA registration, plus a China responsible person and Chinese-language labels.
Is the border agency the same as the market regulator? No. GACC inspects and clears at the port; SAMR supervises the product in the market (sampling, recalls, advertising). NMPA owns pre-market registration of drugs, devices and cosmetics.
Do I need CCC, and who issues it? Only for products on China's compulsory certification catalogue (electronics, many appliances, toys, some auto parts). CNCA administers CCC; goods without it are stopped at the border.
Who registers my overseas food factory? GACC, under Decree 248/280. Most food manufacturers — and the 17 high-risk categories under Decree 280 — must register before exporting to China.
Who sets the standards my product must meet? The National Health Commission (NHC) sets food-safety and many GB standards; SAMR enforces them; CNCA sets certification rules; GACC enforces at import. Chinese national standards apply, not EU/US equivalents.
